My gym membership is up for renewal this month so a couple of weeks ago I go the new contract in the mail. Normally it renews at 15 months for the price of 12 months. This time they sent the contract offering 24 months for the price of 12. Score!
I have been busy but since my contract is up tomorrow, tonight I go in to do the renewal. The sales lady tells me that she can't process my renewal because the gym has been sued over the BOGO offer and they have been told they can no longer offer that deal. Well, my contract was sent out before they agreed to stop offering that deal and I signed the contract before I arrived at the gym to pay. So now I have to wait for the manager to call me to see if they are going to honor the offer. Obviously, I want deal that was offered to me, but I have no idea if they will still honor it. I personally think they should since I have it in writing but I don't know legally how it works since they were sued.
This is really just a vent, but of anyone has any advice I would appreciate it. Thanks for reading, sorry it is so long.

(((hugs))) that sucks....did you turn it in signed or when you went yesterday? I think when they receive the contract matters and whether the contract has a clause in it for making changes without notification.
The gym calls it a BOGO. The lawsuit was from a guy whose wife was offered the special for renewal but he was not. The special is offered to people who do not use the gym frequently (yes, I know I should go more) and the guy who sued is there every day so of course he did not get the special.
I can't imagine that it is illegal but the gym agreed longer offer the BOGO. I think I should still get the offer since they sent it before they agreed to stop.
I can see your thinking, and also theirs. I think had you returned it to them before they stopped it they would have to do it but now it's in that grey area. Maybe you can ask them what they can do for you instead, express your disappointment to the manager...surely they have something they can offer you as a compromise to keep you happy and as a customer.
The gym left a message that our membership renewal has been processed and we should stop by the sales office to pick up our free massage gift certificates and schedule our free training session. Glad I don't have to worry about gym fees until 2014.
